A former lands registrar at the Ministry of Lands on Wednesday told a Nairobi Court that a former chief and officials of a self-help group forged a title deed for land worth Sh944 million in Donholm Estate.
Rosemary Ngong’a on Tuesday told Milimani Chief Magistrate Wendy Micheni that a certificate of lease issued to the Sowesava Self-help Group allegedly signed by her was forged.
“I confirm that having been shown the certificate of lease purportedly signed by myself and issued to Sowesava self-help group. My take is that having looked at the signature, I can confirm that I am not the author and I didn’t issue any title to the said Sowesava,” she told the court.
Furthermore, Ngong’a stated that a Self-help group is not an entity to be issued with a title.
Procedurally, it’s the names of the trustees to appear on the title.
Ngong’a was testifying against Alexander Hoops, Patrobas Awino and Peter Gitau and Peter Njoroge, accused of forging a title deed, a lease and an allotment letter.
Her evidence was also corroborated by Ngarwa Kamuya an advocate who also confirmed to the Court that his signature was forged.
He told Court that on the date that he allegedly witnessed the signing of the lease, he was in form one.
In the case, they are accused that on unknown dates jointly with others not before the court, with intent to defraud Gidjoy Investment Ltd of 11.8 acres of land in Donholm, they made a false allotment letter purporting to be genuine and issued by a lands administration officer.
The disputed parcel of land is the formerly Nairobi /block 82/7333, now part of the amalgamation of other parcels valued at Sh944 million.
They also face a second count of forging a lease purportedly signed by Rosemary Ngong’a, a land Registrar, on unknown dates within the country.
They further face a third count of forging a title deed with intent to defraud Gidjoy investment Ltd by forging a title deed purportedly issued by Ngong’a.
The court also heard that the four forged a lease document purportedly signed and stamped by Ng’arua Kamuya Ng’arua and Kamau an advocate of the High Court of Kenya.
The accused persons were further accused of conspiring to defraud Gidjoy investments limited by falsely pretending that they had a genuine title dated November 28, 2001, issued and signed by Ngong’a.
